1. Acceptance of Terms

By accessing or using Barikhan Studio's live streaming platform and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Barikhan Studio provides a professional live streaming platform that enables users to:

  • Broadcast live video to multiple platforms simultaneously
  • Record and store streaming content
  • Host virtual studios with multiple participants
  • Create and share video clips
  • Access analytics and audience insights

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account
  • Not share your account with others

You must be at least 13 years old to use the Service. If you are under 18, you must have parental consent.

4. Subscription and Payments

4.1 Subscription Plans

Barikhan Studio offers various subscription plans with different features and limitations. Plan details and pricing are available on our website.

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

4.4 Lifetime Deals

Lifetime deals purchased through promotional partners (e.g., AppSumo) are subject to the terms specified at the time of purchase. These deals provide access to the Service for its operational lifetime, subject to fair use policies.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Transmit harmful or malicious content
  • Broadcast illegal, violent, or adult content without proper labeling
  • Harass, abuse, or harm others
  • Spread misinformation or engage in fraud
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to systems
  • Use automated systems to access the Service
  • Resell or redistribute the Service without authorization

6. Content Ownership

6.1 Your Content

You retain ownership of all content you create, upload, or broadcast through the Service ("Your Content"). By using the Service, you grant us a license to host, store, and transmit Your Content as necessary to provide the Service.

6.2 Our Content

The Service and its original content (excluding Your Content), features, and functionality are owned by Barikhan Studio and are protected by intellectual property laws.

6.3 Content Responsibility

You are solely responsible for Your Content and the consequences of broadcasting or sharing it. We do not endorse any user content and are not liable for content created by users.

7. Third-Party Platforms

The Service allows you to stream to third-party platforms (YouTube, Twitch, Facebook, etc.). You are responsible for complying with the terms of service of those platforms. We are not responsible for any actions taken by third-party platforms regarding your content or account.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Barikhan Studio SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption
  • Cost of replacement services
  • Any damages arising from your use of the Service

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Barikhan Studio and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time through your account settings.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
